Briton guilty of producing porn

Siem Reap Provincial Court yesterday convicted a British expat with producing pornography over the promotion of a pool party using images deemed “pornographic”, sentencing him to one year in jail but suspending10 months of the term.

Daniel Jones, 31, was among 10 foreigners arrested in January after police raided their pool bash at a private villa in Siem Reap, a popular hub for tourists near the Angkor Wat temple ruins.

The court ultimately dropped charges against the others but pursued a case against party organiser Mr Jones, who was held in jail for nearly two months before his trial last week.

Yin Srang, the provincial court spokesman, said Mr Jones was convicted yesterday and sentenced to one year in jail, but noted that the judge suspended 10 months of the term, meaning Mr Jones could be freed from prison today with time served depending on a possible appeal by the prosecution.

Prosecutor Then Samnang told reporters yesterday that he is considering appealing the verdict, and added that he will ask for the opinion of higher-level court officers. He then declined to comment further.

Mr Jones’ defence lawyer Sourng Sophea accepted the verdict but insisted that his client is innocent and should be released immediately.

“The provincial court prosecutor does not appeal against this type of verdict. My client should be able to leave prison on Wednesday,” said Mr Sophea. “However, he could spend more time in jail if the prosecutor appeals the sentence.”

“The decision on whether or not Mr Jones can leave prison now rests with the prosecution,” he added.

During his trial, Mr Jones admitted to advertising the ‘Let’s Get Wet’ event for which the images were used and apologised for his offensive actions.

According to Mr Jones, he did not know the images breached Cambodia’s indecency law.

“Now I understand in Cambodia that these pictures are not good,” he told the court, adding he did not take the photos himself.

Mr Jones noted that there was no nudity or sex involved at the party.

The foreigners were arrested in Siem Reap in January for organising the party which officials described as ‘porn dancing’ at a venue in the tourist town, which attracted at least 77 other tourists.

The other nine tourists arrested over the party were deported back to their respective countries after charges were dropped in February.
