Casino fires employee after labour complaint

Another Grand Diamond City Casino staff member has been fired after complaining of abusive labour conditions at the casino in Banteay Meanchey province’s Poipet town.

Pav Sina, president of the Collective Union of Movement of Workers, said that Om Chhayya, who was a staff member at the casino and also a part of the union, was fired on Wednesday after giving an interview to a radio station last week in which he complained of abusive labour conditions.

In the radio report, Mr Chhayya said the casino was forcing workers to work 12-hour shifts contrary to labour law and not compensating them for overtime or days worked on national holidays.

Mr Sina said that the allegations were true, and were also raised by former staff member Bun Sothy, who was then fired from his position last month.

“What he said was not wrong,” said Mr Sina. “Last month, the union filed a complaint to the provincial labour department to have the casino investigated for labour abuses after complaints from workers.”

Ros Sarum, director of the labour department, said the complaint filed only had the signatures of five employees on it, meaning that he could not launch an investigation.

Mr Sarum explained that according to the union law, complaints must have signatures from 30 percent of workers in order for an investigation to be launched.

“The company has more than 2,000 workers and only five people petitioned the department to investigate the company,” he said.

“It is not according to the law. I am not protecting the company; I am just following the law.” “So, if at least 30 percent petition my department, we will launch an investigation,” he added.

The CUMW wants the casino to obey all labour laws, including standard eight-hour work shifts and back-pay owed to the staff who worked on national holidays but did not receive any bonuses since 2014.
